Welcome to QuickScriber. These Terms of Service ("Terms") govern your access to and use of the QuickScriber website, applications, and services (collectively, the "Service"). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the Service after any modifications indicates your acceptance of the updated Terms.

2. Description of Service

QuickScriber is a video transcription service that allows users to:

Upload video files (MP4, MOV, AVI, MKV, WebM) up to 2GB for transcription
Transcribe videos from YouTube, TikTok, and Instagram via URL
Download transcripts in various formats (Text, JSON, SRT subtitles, DOCX)
Access transcription history through their account
Pro features: Speaker identification, AI sections & summaries, automatic detection of 50+ languages

We use advanced AI technology to process audio and generate transcripts. While we strive for high accuracy, we do not guarantee 100% accuracy of transcriptions.

3. Account Registration

To access certain features of the Service, you must create an account. When registering, you agree to:

Provide accurate, current, and complete information
Maintain and promptly update your account information
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized access or security breaches

You must be at least 13 years old to create an account. If you are under 18, you must have parental or guardian consent to use the Service.

4. Subscription Plans and Payment

4.1 Plans

QuickScriber offers the following subscription plans:

Free: 30 minutes of video transcription per month, max 30 min video length, Text/JSON/SRT export, YouTube/TikTok/Instagram support
Pro ($19/month): 1800 minutes (30 hours) per month, max 2 hour video length, all export formats including DOCX, speaker identification, AI sections & summaries, automatic detection of 50+ languages, priority support

4.2 Billing

For paid subscriptions:

Payment is charged at the beginning of each billing cycle
Subscriptions automatically renew unless cancelled
Prices are subject to change with advance notice
All payments are non-refundable unless otherwise required by law

4.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing period. Unused transcription minutes do not roll over to the next period.

5. Acceptable Use

You agree to use the Service only for lawful purposes. You must NOT:

Upload content that you do not have the right to use or distribute
Upload content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
Upload content containing child exploitation material
Infringe on the intellectual property rights of others
Attempt to gain unauthorized access to our systems or other users' accounts
Use automated systems or bots to access the Service without permission
Interfere with or disrupt the Service or servers
Reverse engineer, decompile, or disassemble the Service
Use the Service for competitive analysis or to build a competing product
Exceed your plan's usage limits or circumvent usage restrictions

6. Content Ownership and Rights

6.1 Your Content

You retain all ownership rights to the video content you upload and the resulting transcripts. By using our Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing the transcription service.

6.2 YouTube Content

When transcribing YouTube videos, you represent that you have the right to transcribe the content or that such use is permitted under applicable law (e.g., fair use). You are responsible for ensuring your use of transcribed YouTube content complies with YouTube's Terms of Service and applicable copyright laws.

6.3 Our Content

The Service, including its design, features, and underlying technology, is owned by QuickScriber and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the Service, you agree to our Privacy Policy.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

Warranties of merchantability or fitness for a particular purpose
Warranties of accuracy, reliability, or completeness of transcriptions
Warranties that the Service will be uninterrupted, timely, secure, or error-free
Warranties that defects will be corrected

Transcription accuracy depends on audio quality, background noise, accents, and other factors. You acknowledge that transcripts may contain errors and should be reviewed before use in any critical application.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUICKSCRIBER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, data, use, or goodwill
Any damages resulting from transcription errors or inaccuracies
Any damages arising from your use or inability to use the Service

In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless QuickScriber and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including intellectual property rights
Any content you upload to the Service

11. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause or notice, including for:

Violation of these Terms
Fraudulent, abusive, or illegal activity
Non-payment of fees
Extended periods of inactivity

Upon termination, your right to use the Service will cease immediately. Provisions of these Terms that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QuickScriber is incorporated, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and QuickScriber regarding the Service and supersede all prior agreements and understandings.
